Contractor headcount and attendance tracking software works by comparing three numbers that most companies hold in three different places: headcount approved on the work order, headcount deployed by the agency, and headcount verified present at the site. Overbilling lives in the gap between the second and third.

The reconciliation only holds if the third number is trustworthy. A verified present count built from proxy punches, off-site marking, or supervisor-entered attendance is not independent evidence, and a reconciliation run against it produces false confidence rather than control.

What India’s Labour Codes and the DPDP Act Change for Contract Labour Attendance in 2026

India’s four Labour Codes took effect on 21 November 2025, with final central rules notified on 8 May 2026 and state-level rules still rolling out. The Contract Labour (Regulation and Abolition) Act, 1970 has been consolidated into this framework, primarily under the Occupational Safety, Health and Working Conditions Code, so “Contract Labour Act” remains usable shorthand but is no longer the current standalone legal framework.

Social security coverage changed materially. Under the Code on Social Security, 2020, provident fund, ESIC, insurance, and gratuity are being extended to contract, fixed-term, gig, and platform workers rather than permanent staff alone. ESIC now applies nationwide rather than only in notified areas, is mandatory even where a single worker is engaged in a hazardous process, and is available voluntarily to establishments with fewer than 10 employees.

Fixed-term workers are entitled to the same social security benefits as permanent employees, with gratuity eligibility reduced to one year of continuous service, and the principal employer carries responsibility for social security and health benefits for contract workers. Registration for gig and platform workers is mandated under the May 2026 central rules, with aggregators required to register workers on the designated portal within 45 days. Contribution rates and exact benefit structures are still being operationalised, so treat this coverage as being extended rather than fully settled.

Data privacy runs on a separate track and should not be conflated with labour law. The Digital Personal Data Protection Act (DPDP Act), 2023 governs how biometric and attendance data is collected, stored, and processed for Indian data subjects, with rules notified in November 2025, consent-manager provisions becoming operative in November 2026, and full substantive compliance obligations enforced from 13 to 14 May 2027.
